Milwaukee County Business Licenses: West Allis, Wauwatosa and the Suburbs
Milwaukee County Business Licenses: West Allis, Wauwatosa and the Suburbs
If you are opening a business in West Allis, Wauwatosa, Oak Creek or another Milwaukee County suburb, start with one fact that saves time: neither the state nor Milwaukee County issues a general business license. Wisconsin licenses activities, not businesses. Your registration and licensing needs depend on what you sell, what you serve or do, whether your work is regulated, and which city or health department covers your address.
This guide covers the paperwork that matters most for suburban Milwaukee County: entity filings with the Department of Financial Institutions (DFI), the seller's permit from the Department of Revenue (DOR), the sales tax and exposition district taxes that apply countywide, and the local licenses and health permits that vary by city.
The short answer: licenses follow the activity
Wisconsin does not have a single license that lets you operate. Instead, a suburban business usually deals with four separate sources:
- DFI for forming and maintaining an LLC or corporation, and for optional trade name registration.
- DOR for a seller's permit if you sell taxable products or services.
- Municipal clerks for alcohol licenses and other listed activities.
- Health departments, DSPS (for regulated occupations) and DATCP (or a local health department acting as DATCP's agent) for food and other activity-specific licenses.
Suburban cities also apply their own zoning and occupancy rules, so a state filing alone does not mean you can open the doors.
State registrations and what they cost
Most of the fees below are set by DFI and DOR, and they apply the same way in West Allis, Wauwatosa and Oak Creek as they do anywhere else in Wisconsin.
| Filing | Agency | Cost | Notes |
|---|---|---|---|
| LLC Articles of Organization (Form 502) | DFI | $130 | Optional expedited service adds $100 |
| Corporation Articles of Incorporation, Stock (Form 2) | DFI | $100 | For-profit corporations |
| LLC Annual Report (Form 5) | DFI | $25 online, $40 by mail | Required every year |
| Corporation Annual Report (Form 17) | DFI | $25 online, $40 by mail | Required every year |
| Name reservation (Form CORP1) | DFI | $15 | Holds the name for 120 days |
| Trade name registration (DBA) | DFI | $15 | Optional; renewal is also $15 |
| Seller's Permit | DOR | $20 for the first two years, $10 every two years after | Required if you sell taxable goods or services |
Annual reports are due during the calendar quarter that contains your anniversary of formation: March 31, June 30, September 30 or December 31. Foreign LLCs pay $80 and are due March 31. Paper filings carry a $15 surcharge, so filing online at the lowest cost makes sense for most owners.
Form your entity at the DFI Business Entity File Online page, and check name availability in the DFI corporate records search. A preliminary search is not a reservation. Availability is only final once DFI examines and files your document. LLC names must include 'limited liability company,' 'limited company,' 'LLC' or 'LC', or a variation that differs only in capitalization or punctuation.
Registered agent requirements
Every LLC and corporation must keep a registered agent with a registered office in Wisconsin. The office must be an actual physical street address, not a P.O. Box, mailbox service or telephone answering service, and it must match the agent's business office. The formation document and every annual report must list an email address for the agent, because DFI sends annual report forms and official notices there. Your company cannot name itself as its own registered agent. A change of agent or office costs $10 online or $25 on paper.
If you plan to use a registered agent service, compare the annual cost and whether it provides a real street office in Wisconsin. Suburban owners who work from home often need one for this reason.
Sales tax in West Allis, Wauwatosa and Oak Creek
Searches for milwaukee county sales tax, milwaukee county sales tax rate, west allis sales tax, wauwatosa sales tax and oak creek sales tax usually come down to one rate. Outside the City of Milwaukee, the combined rate is 5.9%:
| Component | Rate |
|---|---|
| State sales tax | 5% |
| Milwaukee County sales tax (since 1/1/2024) | 0.9% |
| Combined rate outside the City of Milwaukee | 5.9% |
That combined figure covers West Allis, Wauwatosa, Oak Creek and the other suburbs. A business in the City of Milwaukee is on a different page and should not use the suburban figure.
Two practical points. First, the rate tells you what to charge, not whether a sale is taxable. Whether a specific product or service is taxable is a DOR question, so confirm it before you finalize your pricing. Second, you collect and remit sales tax only after you hold a seller's permit. Register through the DOR Business Tax Registration system or the Wisconsin One Stop Business Portal, which registers a new business with DFI, DOR and the Department of Workforce Development in one pass.
Exposition district taxes countywide
The Milwaukee County exposition district levies several taxes that apply across the county, including the suburbs. If your business is a hotel, restaurant, bar or car rental operator, these matter more than the general sales tax.
| Tax | Rate | Where it applies |
|---|---|---|
| Basic room tax | 3% | Countywide |
| Food and beverage tax | 0.5% | Countywide |
| Rental car tax | 3% | Countywide |
| Extra room tax | 7% | City of Milwaukee only |
The extra 7% room tax does not apply to hotels in West Allis, Wauwatosa or Oak Creek. Because the exposition district taxes are administered separately from the general sales tax, ask the district and DOR how they apply to your specific service before you set rates or open a booking system.
Local licenses: the city clerk and the activity
Suburban clerks issue licenses for alcohol and for activities that the city regulates. Nothing in this category is a general business license. Each city sets its own process, forms and fees, so use the clerk's office as your primary source.
West Allis business license
West Allis does not issue a general business license. Its clerk handles licenses for alcohol and other listed activities. If you plan to sell alcohol, the most important constraint is availability. West Allis caps Class B combination licenses at 120. TMJ4 reported in February 2020 that the city was already over that cap at 122. That report is several years old, so do not assume the number of available licenses today. Ask the West Allis clerk for the current status of Class B combination licenses before signing a lease or buying a liquor license from an existing holder.
Wauwatosa business license
Wauwatosa issues clerk licenses for alcohol and listed activities, but the step that catches most new owners is the occupancy permit. Wauwatosa requires an occupancy permit and a city inspection before you open. Schedule that inspection early, because it can hold up your opening date even if your state filings are complete. The city's opening-a-business guide explains the sequence, so read it before you sign a lease.
Oak Creek and other suburbs
Oak Creek, Franklin, Cudahy, South Milwaukee, St. Francis and the North Shore communities each have their own clerk rules for alcohol and activities. The licensing categories and processing times differ, so confirm the requirements with the clerk for the city where your address sits, not the city where your mailing address is located.
Health departments: find the one that covers your address
Suburban Milwaukee County is served by several health departments, and the one that covers your address determines your food and facility inspections. Mailing address and jurisdiction are not always the same, so check the health department for the parcel you plan to use.
| Area | Health department to confirm |
|---|---|
| West Allis | Southwest Suburban Health Department |
| Greendale | Southwest Suburban Health Department (food licensing agent) |
| Wauwatosa | Wauwatosa Health Department |
| Oak Creek | Oak Creek Health Department |
| Franklin | Franklin Health Department |
| Cudahy | Cudahy Health Department |
| South Milwaukee and St. Francis | South Milwaukee/St. Francis Health Department |
| North Shore communities | North Shore Health Department |
If you sell food, run a bar or operate a personal care business, the health department is usually part of your licensing path. Food licenses can come through DATCP or through a local health department acting as DATCP's agent. Ask the agency that covers your address which path applies to you, and do not assume that a license from one suburb transfers to another.
A practical order of operations
- Decide your entity type. A sole proprietor files nothing with DFI, while an LLC or corporation files Form 502 or Form 2. Confirm the choice with a CPA or attorney if you have owners, investors or complex income.
- Reserve your name if you need time, at $15 for 120 days, or check availability in the DFI records search.
- File your formation document with DFI and appoint a registered agent with a physical Wisconsin office.
- Register for a seller's permit with DOR if you sell taxable goods or services. Budget $20 for the first two years.
- Identify the activity licenses you need: alcohol and listed activities through the clerk, food and regulated activities through the health department or DSPS or DATCP.
- Confirm the zoning and occupancy requirements for your address, including the Wauwatosa occupancy inspection if you are located there.
- Calendar your DFI annual report for the quarter that matches your formation anniversary.
A local Small Business Development Center can review your plan at no cost. The Wisconsin Small Business Development Center Network is run through the Universities of Wisconsin, and the SBA Wisconsin district page lists regional resources.
Where to confirm the details
- Entity filings and annual reports: DFI Business Entities
- Trade names: DFI trade name fees
- Seller's permit and tax questions: Wisconsin Department of Revenue, New Business
- Alcohol, activity and occupancy licenses: the city clerk and building or occupancy office for your address
- Food and health permits: the health department that covers your parcel
This guide is informational and is not legal or tax advice. Fees, cutoffs and processing practices can change, and the city or agency that covers your address has the final word. Before you form an entity, sign a lease or set your sales tax collection process, consult a qualified attorney or CPA, especially if you have multiple owners, a liquor license, or income from more than one jurisdiction.
